1 Agreement to Terms

By accessing or using Mulanen's website (mulanen.com) or engaging our digital marketing services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our website or use our services. These terms constitute a legally binding agreement between you and Mulanen Digital Marketing Agency, registered in Kuwait.

2 Services Description

Mulanen provides digital marketing services including but not limited to:

• Search Engine Optimization (SEO)
• Social Media Marketing and Management
• Paid Advertising (Google Ads, Meta Ads, etc.)
• Content Marketing and Creation
• Web Development and Design
• WhatsApp Business Marketing
• AI Marketing Solutions

Specific services, deliverables, and timelines are defined in individual service agreements or proposals provided to clients.

3 Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information required for services
• Grant necessary access to accounts, platforms, and assets
• Respond to requests for feedback and approvals in a timely manner
• Ensure all provided materials do not violate third-party rights
• Comply with platform terms of service (Google, Meta, etc.)
• Make payments according to agreed terms

4 Payment Terms

• Payment terms are specified in individual service agreements
• Invoices are due within 15 days unless otherwise agreed
• Late payments may incur a 2% monthly fee
• Services may be suspended for overdue accounts exceeding 30 days
• Advertising budget is separate from service fees and billed as incurred
• All prices are quoted in Kuwaiti Dinars (KWD) unless specified otherwise

5 Intellectual Property

Client Materials

You retain ownership of all materials, content, and data you provide to us. You grant Mulanen a license to use these materials solely for providing the agreed services.

Mulanen Work Product

Upon full payment, clients receive ownership of custom deliverables created specifically for them (websites, content, designs). Mulanen retains rights to underlying tools, methodologies, and pre-existing materials.

Portfolio Rights

Mulanen may reference completed work in portfolios and marketing materials unless the client requests confidentiality in writing.

6 Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This includes business strategies, customer data, pricing information, and technical details. Confidentiality obligations survive termination of services for a period of 3 years.

7 Service Guarantees and Disclaimers

While we commit to delivering high-quality digital marketing services:

• We do not guarantee specific rankings, traffic, or conversion results
• Digital marketing outcomes depend on market conditions, competition, and platform algorithms
• Results from advertising depend on budget, targeting, and market factors
• Website performance depends on hosting, content, and external factors

We commit to using industry best practices and transparent reporting on all marketing activities.

8 Limitation of Liability

To the maximum extent permitted by Kuwait law:

• Mulanen's total liability shall not exceed fees paid in the 6 months preceding any claim
• We are not liable for indirect, incidental, or consequential damages
• We are not responsible for third-party platform changes, outages, or policy violations
• We are not liable for losses resulting from client-provided inaccurate information

9 Termination

Either party may terminate services:

• With 30 days written notice for monthly retainer services
• Immediately for material breach not cured within 15 days of notice
• Immediately for non-payment exceeding 45 days

Upon termination, client receives all completed work and access credentials. Fees for work completed are due regardless of termination.

10 Website Use

When using our website, you agree not to:

• Use automated systems to access the website without permission
• Attempt to interfere with website security or functionality
• Copy, reproduce, or distribute website content without permission
• Submit false or misleading information through forms
• Use the website for any unlawful purpose

11 Governing Law

These terms are governed by the laws of the State of Kuwait. Any disputes shall be resolved in the courts of Kuwait City. Before initiating legal action, parties agree to attempt resolution through good-faith negotiation for a period of 30 days.

12 Modifications to Terms

Mulanen reserves the right to modify these Terms of Service at any time. Changes become effective upon posting to this page. Continued use of our services after changes constitutes acceptance of the modified terms. We will notify active clients of material changes via email.
